Terms of Use


This Agreement constitutes a legally binding contract between ElFnon Information Technology Company and any individual or entity using its services. By using any of the Company’s services, the Client expressly agrees to all terms and conditions, including hosting, software development, technical support, and system management services.

1 Scope of Services

  • The Company provides services including software development, system design, application development, hosting, technical support, server management, and related technical services
  • All services are provided on a best-effort basis without guaranteeing specific commercial or operational outcomes

2 Legal Acceptance

  • Use of any service provided by the Company constitutes full and binding acceptance of this Agreement
  • The Client confirms they are legally capable of entering into this Agreement

3 Limitation of Liability

  • The Company shall not be liable for any direct, indirect, incidental, or consequential damages, including data loss, service interruption, or loss of profits
  • The Company’s total liability shall in all cases be limited to the total amount paid by the Client for the service during the contract period

4 Hosting and Ongoing Services

  • Hosting services are provided based on available resources without guaranteeing unlimited capacity
  • The Company reserves the right to suspend any account that causes abnormal server load or affects other clients
  • Backups are a shared operational responsibility unless otherwise agreed in writing

5 Technical Support

  • Technical support is available only during official working hours defined by the Company
  • Requests are prioritized based on severity without guaranteed response times unless specified in enterprise agreements
  • Support covers technical system issues only and does not include content management or additional development work

6 Payments and Subscriptions

  • All paid or subscription-based services require full payment prior to execution or renewal
  • The Company reserves the right to suspend or terminate services in case of delayed payments
  • Fees are non-refundable once execution has started, except as stated in the refund policy

7 Refund Policy

  • Refunds apply only to shared hosting services within 14 days of activation
  • Refunds do not apply to development, design, programming, technical support, or domain registration services
  • Domain fees are non-refundable once registered
  • Any payment processing or transfer fees will be deducted from refunded amounts
  • Costs of any work already performed will be deducted before any refund is issued

8 Intellectual Property

  • All code, systems, and designs remain the property of ElFnon unless ownership is explicitly transferred in writing
  • Unauthorized copying, resale, modification, or redistribution is strictly prohibited

9 Client Responsibility

  • The Client is fully responsible for all data, content, and usage within the systems
  • The services must not be used for any illegal, harmful, or internationally prohibited activities
  • The Client assumes full legal responsibility for misuse of services

10 Security and System Protection

  • Any attempt to hack, exploit, or damage the Company’s technical infrastructure is strictly prohibited
  • The Company reserves the right to suspend any service in case of security threats or abnormal usage patterns

11 Termination of Service

  • The Company may suspend or terminate services immediately in case of violation, misuse, or technical/legal risk
  • Termination does not obligate the Company to continue service delivery

12 Force Majeure

  • The Company shall not be liable for delays or service interruptions caused by events beyond its control, including natural disasters, internet outages, third-party failures, or cyberattacks

13 International Legal Jurisdiction

  • This Agreement applies globally to all clients regardless of location
  • In case of disputes, the governing law shall be the law of the Company’s primary jurisdiction unless otherwise agreed

14 Indemnification

  • The Client agrees to indemnify and hold the Company harmless from any claims, damages, or legal actions resulting from misuse of services or violation of this Agreement
